This Trademark Policy explains the ownership and permitted use of trademarks, logos, brand names and other identifying marks appearing on the Hyper Labs website.
1. Hyper Labs Trademarks
The name Hyper Labs, together with any associated logos, names, slogans, designs or other brand elements used by Hyper Labs, may constitute trademarks or other intellectual property rights belonging to Hyper Labs or its authorised licensors.
Unauthorised use of Hyper Labs trademarks, branding or logos is not permitted without prior written consent.
2. Third-Party Trademarks
The Hyper Labs website may refer to third-party brand names, product names, logos or trademarks.
All third-party trademarks remain the property of their respective owners.
The appearance of a third-party trademark on our website does not, by itself, mean that Hyper Labs owns that trademark or that the relevant trademark owner endorses, sponsors or is affiliated with Hyper Labs.
3. No Unauthorised Affiliation

Businesses must ensure that claims about products, sponsorship, approval and other characteristics are accurate and not misleading under Australian Consumer Law.
4. Use of Third-Party Brand Names
Third-party brand names may sometimes be used where reasonably necessary to accurately identify or describe a genuine product, compatibility, service or other legitimate purpose.
Any such use is intended to identify the relevant third-party brand or product and does not necessarily indicate ownership, sponsorship or endorsement.
Where a third-party trademark is used as a trademark or in marketing goods, appropriate permission or authorisation should be obtained where required by law. IP Australia notes that use of a trademark in relation to goods can include use on packaging and marketing such as websites.
5. Prohibited Trademark Use
Without appropriate authorisation, you must not use Hyper Labs trademarks or branding in a way that:
- suggests that you are Hyper Labs;
- suggests an official relationship with Hyper Labs;
- suggests sponsorship or endorsement by Hyper Labs;
- creates confusion about the source of goods or services;
- reproduces Hyper Labs logos or branding for commercial purposes; or
- otherwise infringes Hyper Labs' intellectual property rights.
Similarly, Hyper Labs will not knowingly use third-party trademarks in a manner that falsely suggests sponsorship, approval, endorsement or affiliation.
6. Product and Brand Representation
Hyper Labs aims to ensure that product names, descriptions, images and brand information presented on the website accurately represent the products being offered.
We do not knowingly make false or misleading claims about the origin, quality, characteristics, sponsorship, approval or affiliation of products.
Australian Consumer Law requires businesses to ensure that claims about products and services are accurate, truthful and supported by reasonable grounds.
7. Intellectual Property Rights
Nothing in this Trademark Policy transfers ownership of any trademark or other intellectual property right to another person or business.
All rights in trademarks remain with their respective owners.
Trademark protection and infringement can depend on the particular mark, goods or services involved and how the mark is used. IP Australia explains that registered trademark infringement generally involves unauthorised use of a protected sign in relation to the relevant goods or services.
